On 24th June 2008, the Federal Antimonopoly Service (FAS Russia) dismissed the petitions of «Khabarovsknefteproduct» OJSC on purchasing 100% shares of the registered capital of «Rossiniela» Ltd. and 100% shares of the registered capital of «Grand Rossiniela» Ltd.
Having analyzed the presented documentation, FAS Russia established the following:
«Khabarovsknefteproduct» OJSC has the dominant position on the market of retail sales of auto-petrol and diesel fuel in Khabarovsk.
«Khabarovsknefteproduct» OJSC is included in the Register of economic entities with over 35% share on the market of certain goods, particularly, in the commodity group for retail sales of auto-petrol within geographic boundaries of the Khabarovsk region with the share over 65%.
«Rossiniela» Ltd. owns 11 refueling stations, 9 of which are located in Khabarovsk. «Grand Rossiniela» Ltd. owns 3 refueling stations in Khabarovsk.
The Antimonopoly Service concluded that transactions would strengthen the dominant position of «Khabarovsknefteproduct» OJSC on the market of retail sales of auto-petrol and diesel fuel in Khabarovsk, which would restrict competition.
