On 7th October 2008, the 9th Arbitration Appeal Court sustained the ruling to the Moscow Arbitration Court of 1st July 2008, which dismissed the claim of Mortier Catering N.V. on invalidating the decision of the Federal Antimonopoly Service (FAS Russia) on the antimonopoly case against non-corporated entrepreneur R.Pashkov.
On 22nd February 2007, FAS Russia terminated the antimonopoly case initiated upon a petition of Mortier Catering N.V.
The case is terminated because MR Pashkov did not breach Part 2 Article 14 of the Federal Law «On Protection of Competition» by acquiring and using exclusive rights for trade marks according to Nos. 263895, 173782 and 266942 Certificates.
