On 22nd July 200, Moscow Arbitration Court dismissed the claim of "Angstrem" OJSC on invalidating the decision of the Federal Antimonopoly Service (FAS Russia).

On 15th October 2009, FAS Russia found that "Angstrem" OJSC and "Smartronics projects PTE LTD." violated Parts 1 and 2 Article 11 of the Federal Law "On Protection of Competition" (competition - restricting agreements and concerted actions).

"Angstrem" OJSC and "Smartronics projects PTE LTD." violated the antimonopoly law by concluding an agreement (a contract) that contains anticompetitive provisions.

In particular, the contract requires that within the whole period of its validity (until the end of 2009) "Angstrem" OJSC assigns to "Smartronics projects PTE LTD." the exclusive right for buying microcontrollers ?5004??1-017 in the Russian Federation, Europe and Asia. "Angstrem" OJSC also undertook obligations that without preliminary written permission of "Smartronics projects PTE LTD." it cannot sell directly or through an intermediary microcontrollers ?5004??1-017, accept and execute any requests of other buyers of ?5004??1-017, sell directly or appoint other agents to sell microcontrollers ?5004??1-017 and forward to "Smartronics projects PTE LTD." all enquiries from other clients for ?5004??1-017.

"Angstrem" OJSC is the leading Russian company in radio-electronics.

Microcontrollers ?5004??1-017 are essential components of protected electronic control tape (EKLZ), mandatory to use in cash-register equipment in the Russian Federation. Currently only this type of microcontrollers is allowed by the Federal Security Service for use in protected electronic control tape.

According to Maxim Ovchinnikov, the Head of the Department of Industry Control, the FAS Russia's decision is undoubtedly legitimate and is taken to eliminate one of the major barriers for entry to the market of protected electronic control tape in the Russian Federation.
